Time limit for an unfair dismissal claim

The time limit for a claim of unfair dismissal on grounds of redundancy is three months from the date of dismissal. There is discretion to extend this time limit if it was not reasonably practicable to issue the claim within that time but time extensions are rare. The three-month limit should not be confused with the six-month time limit for claiming a statutory redundancy payment (see Chapter 7). It is vital to be clear about the dismissal date and not to leave the claim until the last minute. The introduction of tribunal fees from 29 July 2013 has not altered the three-month time limit.
