Who should disclosures be made to?
[ch 13: pages 466-467]Workers should make the disclosure to their employer, or if they don’t want to do this, to a “prescribed person”. This will normally be a regulator, such as the Health and Safety Executive or HM Revenue & Customs or the specific regulator for the relevant sector. The government has published an online list of “prescribed persons”. A trade union rep is not a prescribed person. The legislation is designed to strongly discourage disclosures to the media.
One surprising omission from the list of prescribed persons is the Equality and Human Rights Commission. The government has agreed to correct this. The police are also not included and the government is considering whether to add them.
