Pay: getting it right - bargaining information for union reps

Chapter 2

Travelling between assignments and the NMW

[ch 2: page 17]

An hourly paid worker is entitled to the NMW for time spent travelling between assignments, at least when there is not enough time between assignments to travel back to their own home. The source of the duty to pay is regulation 15(3)(b) NMWR. This was cited in a ruling by the Employment Appeal Tribunal (EAT) in 2013 (Whittlestone v BJP Home Support Limited [2013] UKEAT 0128/13/1907).
