Exceptions and exemptions for age from the Equality Act 2010
There are a number of exceptions within the Equality Act 2010 (EA 2010) which allow employers to treat people differently according to age; these include:
• the young workers’ pay rates in the National Minimum Wage;
• enhanced redundancy payments;
• pay or benefits that are linked to five years or less service; and
• age-related rules in occupational pension schemes.
