As well as its duties under the TUPE regime, an employer will need to take into account other legal responsibilities when devising TUPE consultation, such as:

• duties under the Equality Act 2010 (including the public sector equality duty);

• equal treatment rights of part-time and fixed-term employees; and

• pensions consultation obligations (see page 67).
