In a landmark case reported in June 2022, Mr T Burke v Turning Point Scotland: 4112457/2021, a caretaker suffering from long Covid symptoms successfully argued he was a disabled person under the Equality Act 2010. This was the first time an employment tribunal recognised long Covid as a disability, although the case does not set a legal precedent (see also Chapter 4 on unfair dismissal cases involving Covid).
