However, it upheld the tribunal’s decision that his health and safety claims should not succeed. The tribunal accepted he had a reasonable belief of circumstances connected with his work which were harmful to health but said this was not the same as a reasonable belief in serious and imminent danger. It said the mitigating measures the DVSA had put in place — which included fewer driving tests, face coverings, vehicle cleaning, and using a table to record driving test results — would have provided reasonable protection.
