Grosset took a claim to an employment tribunal, arguing that the school had discriminated against him because of his disability by failing to make reasonable adjustments, had subjected him to unfavourable treatment, and had unfairly dismissed him. The Court of Appeal upheld the tribunal’s findings that his dismissal constituted disability discrimination and held that the dismissal could constitute unfavourable treatment under section 15 of the Act even though the school was unaware of the causal link between the disability and the misconduct.
