Health and Safety Law 2024

Employers are not obliged to provide smoking shelters. However, if a smoking shelter is already in place, or an employer does decide to build one, they must ensure that the structure adheres to smoke-free legislation in that the shelter must not be enclosed or substantially enclosed. Any buildings or structures erected must be passed by the local council who will also give guidance on their suitability under the law.
