In another case, in 2010, Mr Lynch, an RMT safety rep, was sacked from his job as a tube driver from London Underground after an operational error. An employment tribunal found he had been discriminated against on the grounds of his trade union membership. RMT was successful in making an application for interim relief (see page 56) and London Underground was ordered to pay Lynch’s full wages until the full hearing in March 2011. He eventually won his claim and was reinstated.
