Whistleblowing rights are available to all employees and workers. This includes casual and zero hours contract workers, agency workers, members of a limited liability partnership and, in some circumstances, workers who contract via their own personal service company (Keppel Seghers UK Ltd v Hinds [2014] IRLR 754). Some trainees, such as student midwives or nurses, are also protected. However, protection against suffering detrimental treatment on the ground of having made protected disclosures is not wide enough to cover external job applicants, the EAT confirmed in Sullivan v Isle of Wight Council [2024] IRLR 350.
