Many safety reps have experienced difficulties exercising their right to paid time off, particularly for attending training, so it is important to be aware of cases establishing the law in this area. The Trade Union Act 2016 (see page 47) contained a threat to facility time more generally, including safety reps' rights to time off under the SRSCR. This is separate from the right under the Trade Union and Labour Relations (Consolidation) Act 1992 for trade union officials of independent and recognised unions to a reasonable amount of time off, with pay, from their normal work for attending to specified trade union duties.
