In addition, the duties imposed under the regulations only come into play once an operation gives rise to a real risk of injury, and the burden of proof is on the claimant to show there was such a risk. In Alsop v Sheffield County Council [2002] All ER (D) 45 (Mar) a refuse collector unsuccessfully claimed for damages after slipping and injuring his elbow while pulling a wheelie bin up a ramp. The judge concluded there was no real risk of injury arising from moving wheelie bins up and down a ramp.
