Tackling sexual harassment at work — an LRD guide

Chapter 5

Anonymous evidence

[ch 5: page 52]

Anonymous evidence sometimes features in investigations of allegations of sexual harassment because workers can be reluctant to come forward, especially when the harasser occupies a position of power. The law allows employers to rely on the evidence of workers who want to remain anonymous. But at the same time, the investigation must be fair, or else any dismissal based on the results of the investigation is likely to be unfair. A rep who is representing a member who is facing anonymous witness evidence should ask for guidance from a full-time official.
