Selection for redundancy
[ch 4: page 51]Redundancy is a form of dismissal, and attendance can be used as a basis for redundancy as one of a range of selection criteria. However, it would have a potentially discriminatory impact because, as the statistics in Chapter 2 show, absence rates are likely to be higher for disabled workers and for women (who may be more likely to have caring responsibilities). So it must not be used as the only or determining criterion, according to Equality and Human Rights Commission (EHRC) guidance on avoiding discrimination while making redundancies.
