Changes to the contract terms of new joiners

Only employees who transfer under TUPE are entitled to protection from TUPE-related contract change. Existing employees and new employees taken on after the transfer date do not have a right to the same terms as those who have joined the workforce under TUPE.

The “two-tier code” that existed under the last Labour government and required contractors to offer all outsourced staff the same terms was abolished by the Coalition government. The Employment Rights Bill includes a power to reintroduce it.
