[page 275]Redundancy can be a fair reason for dismissal. However, there are several ways in which a redundancy dismissal can be unfair, including:
• there was no genuine redundancy situation;
• redundancy was not the real reason for dismissal;
• the employee was unfairly selected;
• the employee was selected for an automatically unfair reason, such as pregnancy or lawful trade union activities;
• there was a failure to properly consult;
• the employer breached its own redundancy procedure; or
• there was a failure to offer suitable alternative employment.
