10. Whistleblowing
[page 87]The Public Interest Disclosure Act 1998 introduced provisions in a new Part IVA of the Employment Rights Act 1996 (ERA 96) to protect employees and workers who disclose information about certain types of alleged wrongdoing at work (“whistleblowing”). They give workers the right not to be subject to a detriment, victimised, or dismissed for disclosing certain types of information.
To qualify for protection, the information disclosed must qualify as a “protected disclosure”, which includes being made “in the public interest”.
