Non-disclosure agreements
[ch 12: page 255]Guidance on the use of non-disclosure agreements (NDAs) was published by the Acas employment relations service in February 2020 after widespread criticism of the use of NDAs in alleged harassment and discrimination cases. It advises that while NDAs can be used legitimately in some situations, they should not be used routinely to prevent allegations of sexual harassment, discrimination or whistleblowing. The advice aims to help employers and workers understand what NDAs are, how to prevent their misuse, and show where they will not be needed. It is available on the Acas website.
