Disciplinary action against union representatives

Disciplinary action against union reps can be dealt with under the employer’s normal disciplinary procedures (Acas Code of Practice on disciplinary and grievance procedures, para 30). But Acas Guidance acknowledges that “action against a trade union representative can be construed as an attack on the union if not handled carefully” and the Code advises that in some circumstances it is advisable to discuss the case at an early stage with a union official, after obtaining the employee’s consent.
