Use of non-employment judges
[ch 1: page 9]This is probably the most controversial of the package of measures. The regulations allow a range of non-employment judges to sit as ET judges, including judges of the First-Tier Tribunals and Upper Tribunal, High Court judges, deputy High Court judges and circuit judges. The TUC is concerned about this development because of the risk of introducing non-specialists to a complex field of law and of undermining the relatively informal ethos of the tribunals.
