Law at work 2020 - the trade union guide to employment law

Chapter 10

Redundancy

[ch 10: page 368]

Redundancy can be a fair reason for dismissal. However, there are several ways in which a redundancy dismissal can be unfair, including:

• unfair selection;

• selection for an automatically unfair reason;

• failure to consult properly;

• breach of the employer’s own redundancy procedure; and

• failure to offer suitable alternative employment.

Unfair dismissal for redundancy is looked at in Chapter 11: Redundancy, see page 436.

Reps can find more detailed guidance in the new LRD booklet: Redundancy law — a guide to using the law for union reps.
