An employee’s failure to appeal is also a breach of the Acas Code, which says that where employees feel that disciplinary action is “wrong or unjust”, they should appeal. Employees should therefore think carefully about deciding not to appeal. If they do not appeal and subsequently bring a tribunal claim, any compensation they receive can be reduced by up to 25% for failing to follow the Acas Code if the Code applies (see page 11).
