[ch 13: page 508]Two types of claim can be brought by an employee who has made a protected disclosure, namely automatically unfair dismissal and detriment. A worker can claim only whistleblowing detriment.
The time limits are different for each claim, so early legal advice should be taken. As always, ET deadlines are very short.
Claims for whistleblowing detriment can be brought against the employer, any agents of the employer acting with the employer’s authority and co-workers in the course of their employment.
