Redundancy
[ch 10: page 380]Redundancy can be a fair reason for dismissal. However, there are several ways in which a redundancy dismissal can be unfair, including:
• no genuine redundancy situation;
• redundancy not the real reason for dismissal;
• unfair selection;
• selection for an automatically unfair reason, such as pregnancy or lawful trade union activities;
• failure to consult properly;
• breach of the employer’s own redundancy procedure; and
• failure to offer suitable alternative employment.
Unfair dismissal for redundancy is looked at in more detail in Chapter 11: Redundancy.
