Tribunal claims about time off rights

An employee can bring an ET claim relating to time off, but only if a specific request for time off has been denied (Ryford v Drinkwater [1996] IRLR 16). The claim must be brought within three months, less one day (section 171, TULRCA). The ET can make a declaration of the employee’s rights and award “just and equitable” compensation. Acas Early Conciliation (EC) applies unless there is also an application for interim relief (see page 400). See Chapter 14 for more information about Acas EC.
