Time off for young persons to study or train
[ch 4: page 143]In Wales and Scotland, employees aged 16 or 17 (as well as those who turn 18 during the course of the study or training) are also entitled to paid time off for study or training, if they are not in full time secondary or further education (S.63A ERA 96).
An employee who is unreasonably refused time off under S.63A ERA 96 can bring a claim to the employment tribunal. If successful, the tribunal will make a declaration and order compensation equivalent to the amount of pay the employee would have received if they had undertaken the study or training. Acas EC applies (see Chapter 14).
