What if the employer does not know the worker is disabled?

The duty to make reasonable adjustments does not apply if the employer does not know and could not reasonably be expected to know that the individual is disabled (Schedule 8, para 20(1) EA 10). A careful record should be kept of any notification to the employer. The way the law treats the employer’s knowledge in the context of disability is explained on page 144.
