[ch 3: page 17]Some employers are reported to have responded to the extension of the right to request flexible working by trying to interfere with existing flexible working arrangements, including established homeworking patterns. It should be noted that any changes to contractual terms and conditions, including changes in work location, such as homeworking, must be agreed, just like any other change to a contract term. Otherwise the employer risks a claim for breach of contract. Interfering with an existing working pattern may also be a breach of the EA 2010 (see below).
