Written answers and further information

Another way of extracting useful information from the employer can be via a request for written answers or further information, commonly known in the past as a request for further and better particulars.

It is important that any questions asked are strictly necessary as part of preparations for the hearing. A request for written answers or further information is not an opportunity to score points in the manner of a cross-examination. Such an approach can serve to alert the employer to the weaknesses in their case or risk the tribunal awarding costs for unreasonable conduct of the proceedings.
