Employees off sick during the notice period

An employee off sick during their notice period is entitled to normal full pay during that period, even if they have used up all their sick pay, unless they are entitled to contractual notice of at least a week more than the statutory minimum notice entitlement (section 87, ERA 96). In other words, a member whose employment is terminated for long-term sickness absence must be paid their full notice pay, as long as their contract entitles them to statutory notice.
