[ch 6: page 159]Several European Court decisions have considered the extent to which intended mothers whose babies are born through a surrogacy arrangement should be given protection. The UK has now legislated to improve the rights of qualifying surrogate parents to time off, leave and pay under the Children and Families Act 2014. The new rights will affect babies born on or after 5 April 2015. For more information, see Chapter 8.
Only a biological mother can claim pregnancy discrimination.
