What happens to a claim issued in the tribunal?
When the tribunal receives the Claim form (ET1), it sends a copy to the employer and invites the employer to respond by completing the response form (ET3). At the same time, it normally sends a copy to Acas who will make contact with the claimant (and with the employer) using the contact details put on the form, to see whether either side wants to discuss settlement. Claimants are also expected to complete a Schedule of Losses early in the process. It is very important to be accurate when completing the schedule and to keep all payslips and other documentary evidence that help prove the claim’s value, including evidence of all efforts to find another job. The schedule can be updated as the claim progresses. An accurate and realistic assessment of loss, backed up by supporting evidence, can help promote a settlement.
