Redundancy
[ch 10: page 352]Redundancy can be a fair reason for dismissal. However, there are several ways in which a redundancy dismissal can be unfair, including:
• unfair selection;
• selection for an automatically unfair reason;
• failure to consult properly;
• breach of the employer’s own redundancy procedure; and
• failure to offer suitable alternative employment.
Unfair dismissal for redundancy is looked at in Chapter 11: Redundancy, see page 416.
Reps can find more detailed guidance in the LRD booklet: Redundancy law — a guide to using the law for union reps (www.lrdpublications.org.uk/publications.php?pub=BK&iss=1690) .
