Obligation to provide information

The employer must give the union or other reps, if there is no union, the following statutory information in writing:

• the reasons for the employer’s proposals;

• number and descriptions of employees who may lose their jobs;

• total number of employees;

• proposed selection procedure for job losses;

• proposed method for carrying out dismissals, including timescale;

• proposals for calculating any redundancy pay beyond the statutory minimum;

• the number of temporary agency workers working for the employer;

• where those agency workers are working; and

• what types of work they are carrying out.

Consultation must not be delayed because the employer does not have all the statutory information listed above. Any missing information must be passed to reps as soon as it is available.
