An employee whose employment is terminated for long-term sickness absence must be paid their full notice pay (even if they have used up all their sick pay) as long as their contract entitles them only to statutory notice (section 87, ERA 96). Employers’ pension contributions must be included (University of Sutherland v Drossau [2017] UKEAT/0341/16/RN). See Chapter 10, page 332 for details of statutory notice.
