Bringing a discrimination claim
[ch 7: page 270]Alleging that an employer is guilty of discrimination is a serious step that always needs very careful consideration. It is vital to remain clear, consistent and accurate throughout as to the acts complained of, including any words used, and as to the impact of the discrimination. This will increase the likelihood of being believed.
Although this Chapter largely concerns individual equality rights, in practice equality concerns at work are often best resolved by taking collective action with the support of a union, with or without tribunal litigation. Many key equality cases cited in this Chapter have been brought with union backing.
At some employers where unions are recognised, equality reps have been specifically trained to provide support and advice, and to coordinate campaigns to bring about positive change.
