Personal pension and group personal pension schemes
[ch 6: page 67]The TUPE exclusion applies only to occupational pension rights, not personal pension schemes or group personal pension scheme obligations. These are pension arrangements made directly between the employee and a pension provider, usually an insurance company. They are not specifically set up by an employer to provide benefits to its own employees.
Rights associated with this kind of scheme do transfer with the employment. For example, a contractual promise by the old employer to contribute a fixed amount to a personal or group pension scheme would transfer, and must be honoured by the new provider after the transfer.
