[ch 1: page 9]While the law offers some protections, it does not prevent employers from monitoring their workers using a variety of technologies. Even where employers do cross the boundaries of the law, they can often get away with it in workplaces without well organised and informed trade union reps.
Trade unions have been able to negotiate important protections in workplace policies where employers have implemented monitoring systems. These have included agreements on the appropriate level of monitoring and the boundaries across which surveillance by employers should not pass, as well as agreement on how data, information and observations obtained through this monitoring should be used (see Chapter 8).
