Government proposal: Employee liability information
The government proposes to repeal the requirement to provide specified employee liability information. The government suggests the 14-day timeframe is too short and that a prescribed list encourages transferors to provide information too late and in too limited a way. The government suggests leaving the parties free to contract between themselves to exchange information at the start of a transaction. Most commentators agree that the 14-day timescale is too short, but oppose the idea of leaving the exchange of information as a matter of contractual negotiation. It is particularly unsuitable for incoming service providers taking over a service contract because they have no contractual relationship with the outgoing service provider.
