[ch 5: page 30]In addition to any expert evidence, the claimant in a disability claim is likely to produce a statement detailing their medical condition and, if it relates to the definition of disability, state how this affects their ability to carry out day-to-day activities. As well as providing an expert medical report, a claimant will have to reveal confidential health records, for example, occupational health reports, GP letters, medical history and so on. The employment judge can be asked to make an order limiting what must be disclosed and to whom.
