No detriment
A worker should not be subject to any detriment by any act or failure to act on the part of the employer because they’ve refused to comply with a requirement that contravenes the working time regulations (WTR regulation 31). The following circumstances are also covered: refusing to forgo a right conferred by the regulations; refusing to sign a workforce agreement or vary any other agreement for the purposes of the regulations; bringing proceedings; or alleging that the employer has infringed such a right (whether or not the worker had that right, and whether or not is was infringed). A dismissal under these sort of circumstances would be treated as unfair (WTR regulation 32).
