Disclosure to a legal adviser

A disclosure to a legal adviser while seeking legal advice will be fully protected (section 43D, ERA, 96). This can include a disclosure made to a union’s legal department or union solicitors while seeking legal advice. Whistleblowing charity Protect says that a disclosure to its confidential helpline will count as a protected disclosure to a legal adviser because the advice line is staffed by legally trained advisers and supervised by qualified lawyers.
