Working Time Regulations - Application and enforcement

Chapter 7

Night work limits in specific sectors

Most of the sector-specific regulations don’t attempt to limit night work in general. That is the case in fishing (FVR); the inland waterways (IWR); civil aviation (CAR), although separate CAP371 rules say crew cannot be rostered for more than eight hours per night; and for seafarers (the SHWR regulations prohibit night work under the age of 18 unless it’s part of an established training programme).

The RTR road traffic regulations do limit night work but do so differently from the WTR. If night work is performed, working time should not exceed 10 hours over any 24-hour period unless a collective or workforce agreement is in place (night workers are advised to take a copy of their collective or workforce agreement with them if they plan to exceed the 10-hour night work limit when travelling abroad).
