[ch 10: page 294]Where a driver faces dismissal because he cannot legally do his job due to the loss of his licence, the employer should first look for a suitable alternative employment. However, failing to look for other employment in these circumstances will not always make a dismissal unfair. For example, in Wincanton Group PLC v Gregory [2012] UKEAT 0011/2/1110, the dismissal was unfair because Wincanton actively misled Mr Gregory into thinking it was looking for other suitable jobs for him when this was not true.
