Agency workers’ enhanced rights
[ch 9: page 173]As explained above, agency workers are protected by the WTR, which gives them rights to holidays, rest breaks and protection in relation to night work. In addition, since 1 October 2011, qualifying agency workers also have rights under the Agency Workers Regulations. Under these regulations, agency workers who have worked in the same post for 12 weeks for the same end-user are entitled to benefit from the same main terms and conditions as a comparable employee who is directly employed by the end user. These terms and conditions include contractual rights to rest breaks and holiday.
