Chapter 9

Termination without notice or notice pay

An employer is entitled to dismiss an employee summarily (without notice or notice pay) only in cases of gross misconduct. In all other cases, dismissal must be with notice or notice pay.

An employee dismissed for gross misconduct must be paid their full contractual entitlement up to and including the termination date, including wages, earned overtime and accrued holiday pay.
