[ch 3: page 22]The Health and Safety at Work Act 1974 (HSWA) sets the basic framework for health and safety law in the UK. It also established the Health and Safety Executive (HSE). Employers have a general duty of care under section 2 of the Act to ensure the health, safety and welfare at work of all their employees and this has been interpreted as including employees’ mental health.
