Ban on questions about pension opt-out during recruitment

It is unlawful for an employer or employer’s representative such as a recruitment agency to ask job applicants whether they plan to opt out of a qualifying auto-enrolment pension scheme, or to suggest that their success could depend on whether they opt out. These rules apply whether or not the employer is already subject to pensions auto-enrolment (see page 98).
