The EA 10 covers all those working in Great Britain. Northern Ireland is covered by separate legislation. 




For workers outside Great Britain, the test is whether a claimant has a sufficiently strong connection with Great Britain (Hottak v Secretary of State for Foreign and Commonwealth Affairs & Anor [2016] EWCA Civ 438). This is the same as the test used for claims of unfair dismissal (See Chapter 10). 




Special regulations, the Equality Act 2010 (Work on Ships and Hovercraft) Regulations 2011, apply to extend protection from discrimination, harassment and victimisation to those working at sea. In January 2018, the government published new guidance for seafarers on their rights under both the EA 10 and the National Minimum Wage (see Chapter 4).
